Do I have a legal remedy?

How to Determine if You Have a Case after a Stroke Induced by Chiropractic Treatment

If you have suffered a stroke that you believe was or could have been induced by chiropractic upper cervical manipulation, you will want to talk this over with your medical doctor.

Talk to a Medical Doctor

Your doctor may identify other risk factors that you had before your stroke that may relate to why you had a stroke.

He or she will also most likely talk over with you such matters as timing of your chiropractic treatments and whether you had any suspicious sensations immediately or shortly afterward.

Additionally, you must determine the nature of your stroke, that is, strokes caused by vertebral or carotid dissections are those associated with upper cervical manipulation.

Talk to a Lawyer

In addition to talking with your medical doctor, you may want to talk to an experienced lawyer about the possibility of chiropractic malpractice. A medical malpractice attorney who is knowledgeable about the existence of chiropractic induced strokes will be able to help you determine whether you have a legitimate negligence case.

Chiropractic Stroke Awareness Organization is a non-profit entity dedicated to understanding, evaluating and researching the risks of stroke induced by chiropractic upper cervical manipulation, as well as providing support to stroke victims and their families. In addition to providing a sanctuary where you will be able to connect with others who share your plight, we can provide you with any appropriate and effective legal advocate.  Contact us if you are in need of support, or would like to join us in our quest to raise awareness and increase knowledge about this issue.

Review the Facts

An attorney who may represent you in a chiropractic malpractice case will want to discuss the following questions with you:

  • What happened, and when?
  • What type of stroke did you have?
  • Did you seek medical treatment right away?
  • Did the doctor point out any risk factors for stroke that you had other than your recent chiropractic upper cervical manipulation?
  • Was it, in fact, a stroke, or was it something else that mimicked a stroke?
  • What length of time had passed between your last chiropractic upper cervical manipulation and your stroke?
  • Did your chiropractor discuss risks with you before you underwent upper cervical manipulation?
  • Do you believe that you gave your consent with a clear understanding of the risks?
